Terms and Conditions
This is a courtesy translation. In case of discrepancies, the German version prevails.
1. Scope and contracting parties
These terms govern the use of the revotly application (the «application»), operated by dh training gmbh, Alpenstrasse 1, 3700 Spiez, Switzerland (the «operator», «we»). By creating an account you accept these terms.
Paid subscriptions work differently: we sell revotly Pro through Paddle as a reseller (merchant of record). Your contracting party for the purchase, the payment, the invoice and any taxes is therefore not the operator but Paddle.com Market Ltd, 30 Old Bailey, London EC4M 7AU, United Kingdom (for purchases from the USA: Paddle.com Inc., New York). That purchase is additionally governed by the Paddle Buyer Terms. The present terms, by contrast, govern the usage relationship between you and us.
2. What the service covers
revotly is a web application that lets teachers build quizzes and run them in class. There is a permanently free plan (Free) and a paid subscription (Pro). The features and limits of each plan are listed on the pricing page; the version published there at any given time applies.
We keep developing the application and may add or change features. Should we materially reduce the scope of the service during a period you have already paid for, we will notify you by e-mail in advance; you may then end the subscription early and receive a pro-rata refund of the unused portion.
3. Your account
Teachers need an account. The details you provide must be accurate, in particular a valid e-mail address. Keep your password safe and do not share it; you are responsible for activity carried out through your account.
An account is personal and non-transferable. It is not intended to be shared between several teachers; a school with several teachers needs a corresponding number of accounts.
Participants (students) do not need an account. They join a running session with nothing but a numeric code or a QR code.
4. Prices, payment and renewal
The amounts published on the pricing page apply. Any taxes (such as VAT) are shown and collected by Paddle at checkout. Paddle also issues the invoice; we do not issue invoices and do not collect payments ourselves.
A subscription renews automatically for the same period (month or year) until it is cancelled. Charges are made to the payment method stored with Paddle. You will be informed of price changes in advance; if you do not agree with a change, you may cancel with effect from the end of the current period.
For a yearly subscription, we send you an e-mail reminder about one month before the renewal, so that you can decide without being rushed. Monthly subscriptions get no such reminder, since they renew on a monthly rhythm anyway.
Please direct questions about invoices, payment methods and taxes to Paddle (via the link in your confirmation e-mail or paddle.net). Tax-registered businesses may request a refund of charged taxes from Paddle within 60 days.
5. Term, cancellation and downgrade
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period: Pro remains usable until then, after which the account automatically falls back to the Free plan. An ordinary cancellation does not entitle you to a pro-rata refund of the current period.
You can cancel in the Paddle customer portal — reachable via the link in your confirmation e-mail, via paddle.net, or inside the application under «Account» → «Manage subscription».
When your account falls back to the Free plan, your content is kept. However, for as long as you are above the Free plan's limits, you cannot add new quizzes, slides or images until you are below them again.
6. Refunds
Refunds and the statutory right of withdrawal are governed by our refund policy, which forms part of these terms.
7. Acceptable use
You undertake not to use the application unlawfully or abusively. In particular, the following are not permitted:
- uploading or distributing unlawful content, or content that infringes the rights of others;
- attempts to circumvent a plan's limits by technical means, for instance by creating multiple accounts for that purpose;
- automated bulk access, unarranged load testing, or conduct that impairs operation for others;
- attempts to gain unauthorised access to other people's accounts, sessions or data.
Responsibility for classroom use lies with the teacher running the session, or with the school — in particular for the choice of content and the handling of participants' personal data.
8. Your content
Content you create remains yours. The rights you grant us for technical operation are set out in the «Copyright» section of the legal notice, which also describes the notice-and-takedown procedure.
9. Availability
We operate the application with care, but we do not owe uninterrupted availability. Maintenance, faults at our hosting provider or force majeure may cause interruptions. We will announce larger planned maintenance windows in advance where possible.
A recommendation: do not rely on an internet application alone in class — keep a fallback ready for the day it matters.
10. Suspension and termination by us
In the event of serious or repeated breaches of these terms, we may temporarily suspend or terminate an account. Where proportionate, we will notify you first and give you an opportunity to put things right.
If a payment is charged back, we may suspend access to Pro while the matter is being clarified. Please contact us or Paddle first in such a case — it is almost always easier to resolve than going through your bank.
You may have your account deleted at any time; write to info@revotly.com.
11. Liability
The section «Disclaimer and availability» of the legal notice applies. Mandatory statutory liability — in particular for personal injury and for intent and gross negligence — is reserved in every case.
12. Changes to these terms
We may amend these terms, for example when features change or the legal situation does. We will notify account holders of material changes by e-mail in advance. If you do not agree with a change, you may end your account or subscription as of the date the change takes effect.
13. Governing law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Spiez, to the extent legally permissible. Mandatory consumer protection provisions at a consumer's place of residence are reserved. The purchase contract with Paddle is governed by the choice of law and jurisdiction set out in the Paddle Buyer Terms.
14. Language versions
In case of discrepancies between language versions, the German version prevails.
